Last Will of Nathan WellsThe last will and testament of Nathan Wells deceased, together with Codicils thereto duly probated, proven and admitted to record in the probate court of Clark Co., Ill. 8 oct 1851.
Know all men by these present that I, Nathan Wells, of the county of Clark and state of Illinois, being sick in body, but perfect in mind do make and ordain this to be my last will and testament.
In the first place I order that all my just debts to be paid with funeral
expenses and doctor bills.
Secondly I leave to my wife, Susanna, for the use and maintanance of the
family; two work horses, also, one yoke of work oxen and two log chains and all of the ploughs and harrows with gear sufficient for two horses, and all my sheep, horses and milch cows, all the geese and fanning mill, my wagons to be sold and my executor to purchase one suitable for the family. A sufficiency of meat and grain set apart for the use of the family for one year. The balance of my property not enumerated to be sold. It is my wish that my wife and children should have the use of all the land in cultivation. At my wifes death or marriage, I order all my household and kitchen furniture to be equally divided between her and the children that may then be with her. I order that the store goods and groceries be sold by the executor, the households and lots in Melrose to be sold or rented as they may think best. I give power to Samuel Rubottom to sell for cash until they can be sold, the money to be handed over to the executors.
As to my land I leave it to my son, Joseph, 80 acres that I bought of
Emanuel Dodd on the west side of the prarie, also one colt and one saddle to be bought. I also order my executor to purchase 80 acres of land for my son
William where they may think best. Also 80 acres for my son John. (The words
son and John have been marked out in pencil (Cole and Cole).) The balance of
my land to be equally divided between my sons Peter and Nathan. Also only
reserving the use of it for my wife during her life of widowhood. My dwelling house to be made comfortable, and the fencing on my farm to be kept in good repair for my executor to make all necesary contracts of repair.
I also order my executor to purchase for my four sons William, Peter,
Nathan and John, each a horse worth $40 with a new saddle and bridle for each
as soon as they become of age. What money is on hand I order to be loaned out excepting a sufficiency for the education of the children and family uses. All my outstanding notes I wish to be renewed or collected and my open accounts to be renewed by notes or collections. If my sons should be refractory and cannot get along with, I want my executor to bid them out to such places as they may think best. I wish all my papers relating to the estate of Sara Williard kept by them until they be authorized to pay the same. I wish my pocketbook to be sent immediatly to the nearest magistrate and my estatutes to be sent to the office at Marshall. If it should be supposed by my executor that there would be a surplus of money after all is collected in more than to support the family and education for to pay over to each heir $100 as fast as they become of age and need it. Except Mary, and she is to have $40 less than the rest of my daughters. At my wifes death or remarriage the farming utensiles to be divided by my sons equally.
Lastly it is my wish and desire and I do appoint Peter Medsker as my
executor. In testimony hereof I have aff't my hand and seal this day 21 August A.D. 1846

I now make on the 3rd day of Jun 1847 an amendment to the foregoing will
that I wish my executor to deduct $40 out of my daughter, Eliza Dudley, part of which she has received since the making of the foregoing will, and if there should be any of the estate left afterwords, more than is set forth above, that my executor divide it equally among all my heirs that may be living, and I now do appoint Nickson Evans with Peter Medsker to this my last will and testament.

watch over the family and see there be no unnecessary extravigance or waste.
In testimoney where of I have hereunto set my hand and affixed my seal this 3rd day of June A.D. 1847.

East side of Dolson Prarie be equally divided between my three sons, Peter,
Nathan and John, reserving the use of said land to my wife, Susanna during her life of widowhood or a sufficeincy for her support and children that may be under age and living with her and further $40 to be taken out of Smyrna
Medsker's part, which she has received, and also $40 to be deducted out of
Clarkey Howerton's part, which she has received and Peter Medsker and Nickson
Evans to be my executors, to this my last will and testament.

Brother. D/o Joseph and Margaret Way.
Sent by Mrs. Estol (Mary) Lamb and Janet Lukenbill. Letter dated 24 Aug. 1985, " I have not been able to find where Jesse and Margaret Moore Wells are buried. Feel sure they're in N.E. Twp., Orange Co., Ind. My son and I went thru several cemeteries when there a year ago and lots of field stones where family are buried. Nor could I find a will or probate for Jesse this yr. Difficult without a date. Also watched for Isaac and Zachariah. Should have been guardianship papers for Issac's children. -"
Jesse Wells and his wife did not show up in the 1860 Census, so I can only assume they are deceased by that time. (Janet Lukenbill)
