Joseph W. MILLER

In the Succession of Jane Miller Williams, Ebenezer Miller was appointed tutor
for the minor Whitty Miller on 20 Nov
1844.  Whitty Miller was not named in the will or as a presumptive heir when
the estate was opened in 1840.  Since he
would not be either Ebenezer or James' child, he must descend from one of the
other heirs. Benjamin R. Miller's family
group in 1850 Tensas Parish Census lists a Joseph W. Miller age 21 law student.
Perhaps Joseph had a third son in
addition to Benjamin R. and Pickens E. Millerand the Whitty is based on the
middle name. Alternatively, he could be a
son of Stephen C. Miller. It is unlikely he would be the son of Robert and
Emily Jane Smith Miller given his age and
their probable marriage death.  Since both Pickens E Miller and Benjamin R.
Miller were minors at the time Jane's will
was written (1837) and probated (1840), it is unlikely either would have a 21
year old son in 1850.  Another problem is
that none of Benjamin R. Miller, Pickens E. Miller or Joseph W. Miller is
listed in the Process Verbal of Arbitration
dated 6 Oct 1847 between the heirs of Robert Miller Senior and his wife Sarah
Miller, which presumably included all of
the heirs of Robert and Sarah Miller.

 Jessie Thomas says Martha Gibson was John S. Miller's second wife, and that
he had a child prior to his second marriage. Martha Gibson was married first
to Henry Middleton. She says Martha Gibson Middleton Miller and her family
lived near Port Gibson, Mississippi.
 Perhaps Robert is the son by the first wife, since Martha is mentioned as
natural tutrix of Samuel after John S. Miller's death.  James Miller was
appointed tutor of Robert, who was named as son and heir of John S. Miller in
Appointment dated 9 Jan 1834 (Deed Book F, page 540)
 Land Receipt, United States to Robert Miller, No. 6081. Receivers Office
Ouachita La December 10, 1839 Received from Robert Miller of Concordia County
Louisiana the sum of three hundred Dollars and ninety three cents being in
full for the southwest & east half of South East quarter of Section no. thirty
four in Township No. Ten of Range No. Ten East, containing two hundred and
forty acres and seventy five hundredths at $1.25 per acre. H. Holsus Receiver.
 Conveyance dated 6 Feb 1841: Robert Miller and Mrs. Emily Jane Smith, his
wife, residents of said [Concordia] Parish ...parties of the first part and
Elza C. Nethery and Mrs. Martha Odom his wife ...parties of the second part.
Robert Miller and wife transfer sell and exchange S34, T10, R10E for all of
the fractions of Section 6 in the north half of Section 6, T10, R9E and a
fraction of 18 acres situated west of the Tensas River in Catahoula Parish.
 Conveyance dated April 12 1841. Thomas Coe to Robert Miller. Received of
Robert Miller two thousand eight hundred dollars for eight negroes: Wilson
aged 38 years, Robert aged 33 years, Eliza aged 35 years Edward aged 12, John
aged 10 Mary aged 8, Manual aged 4, Issac 10 months.
