Death Date probably 19 Nov 1850. James R. Williams rendered bill to Robert M.
Simmons estate for "services rendered in taking care of premises and property
belongs to the estate" from Nov. 19 1850 to Feb 1, 1851, and then from Feb1 to
Mar 1.
Assumption since John and Jane Simmons and Eleanor Day and Rebecca Davis
listed as heirs, that Robert M Simmons died childless, thereby making his
siblings heirs. Who then is the Elizabeth Simmons listed with Robert in the
1850 Census?
Robert Simmons listed in 1850 Census of Washington Parish as 61 living with
Elizabeth Simmons 17.
James Williams listed as in family 133, Rebecca Dias in family 134 and
Robert Simmons in family 135. Ellen Day in family 128. James Williams wife
was listed as Jane, age 33, and may have been

The following letter is contained in the Hugh Miller letters:
"Kirks Ferry Tensas, La.
15th March 1860
Hugh R. Miller Esq.
Dear Sir
The much prized box, containing the apple & grape cuttings, came safely to
hand about three weeks ago in excellent condition----The apples were
immediately grafted and the grapes set out---One or two days after the receipt
of the box came your letter of the 9th of Feby. (at night) and the next
morning my wife and myself left for New Orleans from which place we did not
return until a few days ago & I have been so busy since unpacking one years
supplies etc. that this is the first leasure moment I have had to answer your
kind letter.
Since my return home I find that most of the grafts have put out and are
growing finely, the grapes are also budding--I assure you that I prize them
very highly and thank you a thousand times for them--I hope I may be able some
day to offer you fruit from them--I have a very fine orchard of young and
thrifty peach trees of fine varieties--Can I do any thing for you in the way
of collecting peach seed this summer? I should be pleased in some way to
reciprocate your kindness.
I have told all our MILLER kin about the new cousin I found on the steamer
"H. R. W. Hill" & they all express a great desire to see you.
My son and daughter with whom traveled send their best regards to you and my
wife joins me in love to yourself and family.

Note that in 1879 Carroll Parish Census Paul H. DIFFENWORTH, age 2 (probable
son of James M. DIFFENWORTH, son of W. L H. WAILES' aunt) in the family of N?
G. MCGAUGHEY. The fact that each child was listed as owning real estate in the
1879 census indicates that they had probably inherited land from their parents
by then deceased.

My guess (as of 5 May 1997, updated 9 December 1997) is that E. Lloyd WAILES
married one of the children of Stephen C. MILLER as his second wife. My
rationale is as follows: his references in his letter to Hugh Reid MILLER
indicate he married a MILLER; Mary Jane MILLER is named as a minor child in
the Jane WILLIAMS Succession deed in 1840; the references in Zilpah MCGINTY
letter of 18 Jun 1843 refer to Stephen's two daughers as having returned from
school, and thus clearly school-aged; and the 1850 census show Mary Jane as
the 21-year old wife of E. Lloyd WAILES, yet there are two other WAILES
children in the household aged ten and twelve.
Since Ebenezer and Emily Church MILLER were not married until February 1834,
and thus the earliest a child could have been born to them was late 1834 or
early 1835, and could not have been 21 in 1850. Ebenezer is mentioned as
having only one child and James' daughters are accounted for in the 1850
Tensas Parish census. Stephen's other daughter may have been the other female
named in the Jane WILLIAMS succession, Sarah Ann MILLER.
NB: This is verified by Jane MILLER WILLIAMS' will.

Additional information: in a document titled "Process Verbal of Arbitration,
dated October 6, 1847 "we the undersigned heirs to the Succession of Robert
MILLER Senior and his wife Sarah MILLER, also deceased," made an agreement to
arbitrate the final Settlement of Ebenezer MILLER, curator of the Succession.
This document was signed by James MILLER, P. H. DIEFFENWIERTH, S. A.
DIEFFENWIERTH, E. Lloyd WAILES and Eben. MILLER.
Note, however, that it is dated in 1847 and makes no mention of any of the
children of Joseph MILLER (B. R. MILLER or Pickens E. MILLER) or Robert or
Emily Jane SMITH MILLER. B. R. MILLER at least was listed in Tensas Parish in
the 1850 census. Perhaps these other heirs made seperate settlements with
Ebenezer.
