Obediah HIATT

    Obediah Hiett's will was signed 5 May 1885 and proved 31 May 1885.  He left his estate to the children of my sister Polly Gard:
   Hiram Gard, Sophia Palmer, Rowena Camp and heirs of Maria Bowers, Decd.  The children of my sister Amy Jenkins heirs of Eugene Jenkins, son of Amy children of sister Nellie Uhl, Franklin Uhl, Roena Uhl.  Barbara, daughter of brother Samuel heirs of my brother James: Wesley Hiett, Martha Johnson, heirs of Mary Rector, heirs of Virginia Fulton to wife Elizabeth Rebecca Hiett to ward Miss Hattie Chancellor.  One-quater acre reserved for family graveyard.

                       Obediah Hiett's Will
  Know all men by these presents, that I Obediah Hiett, of Williams District, in Wood County, West Virginia, being of sound mind and memory, do make and publish my last Will and Testament, hereby revoking all former wills by me made And first after paying all my just debts and liabilities, I give and bequeath to the following named childrne and heirs of my sister Polly Gard, late Polly Hiett, the following sums of money, to wit: To Hiram Gard, Three Hundred dollars; to Sophia Palmer, late Sophia Gard, Three Hundred dollards; to Rowena Camp, late Rowena Gard, Three Hundred Dollars and to the heirs of Maria Bowers decd, late Maria Gard, Three Hundred Dollars.
  Second.  I give and bequeath to the following named children of my sister Amey Jenkins late Hiett the following sums of money to wit.  To Jefferson Jenkins, Two Hundred dollars and to the heirs of Eugene Jenkins, son of Amy Jenkins, two hundred dollars.
  Third. I give and bequeath to the following named children and heirs of my sister Nellie Uhl, late Nellie Hiett, the following sums of money to wit- To Franklin Uhl, eight ($800) hundred dollars; andd Roena Uhl Two hundred Dollars.
  Fourth - I give and bequeath to Nelley Ewbank (?) daughter of my brother Samuel Hiett, Three Hundred Dollars.
  Fifth - I give and bequeath to the following named children and heirs to James Hiett, my brother, the following sums of money, to wit: To Presley Hiett, two hundred dollars, to Martha Johnson, late Martha Hiett, two hundred dollars, to the heirs of Mary Rector decd late Mary Hiett, two hundred dollars, to the heirs of Virginia Fulton decd, late Virginia Hiett, two hundred dollars.
   Sixth - I give and bequeath to my wife Elizabeth Rebecca Hiatt, as long as she remains my widow my farm and the products thereof for her own use and benefit.  If my wife should marry again, or at the death, whichever shall first occur, the farm must be sold, except one quarter of an acre, where the family graveyard is now located, which must be forever reserved for the sole use and purpose of a family graveyard, and out of the proceeds of such sale, my ward Miss Hattie Chanceller must be paid two Hundred dollars - and the remainder after proceeds of said sale of the farm, after paying Hattie Chanceller Two Hundred dollars aforesaid must be divided among the persons mentioned in items one, two, three, four, and five in the same proportion as mentioned in said items one, two, three, four, and five.
  Seventh, I also give and bequeath to my wife Elizabeth Rebecca Hiett, all my money left after paying my debts and the sums mentioned in items one, two, three, four and five - and all my other personal property for her own use and
benefit.
  Eighth, I hereby constitute and appoint W. F. Bailey to be my executor of this my last will and testament - he to give such bond as the Court may direct.

Witness the following signature and seal this 5th day of May 1885.

Obadiah Hiett whose name is signed to the foregoing will, signed his name thereto in our presence, and we in witnesses whereof have subcribed our names in his presence and in the presence of each other.

   On the 29th day of May 1886,  a paper writing purporting to be the last will and testament of Obediah Hiett deceased was presented to the undersigned in said office and being duly proven by the oaths of Samuel T. Stapleton and A.J. Wick subscribing witness thereto the same in ordered to be recorded.
