State of North Carolina, Superior Court of Law, Haywood, County, October 4, 1824

This day came William Edgar alias William Underwood age 65 years into court being a court of record for Haywood County for the purpose of obtaining a pension as soldier of the  Revolutionary Army being unable to support himself any long by bodily infirmity; That he enlisted in the Virginia Continental Establishment for the War on the 19th of March or there about in 1780 for the War, in the county of Culpeper; That he was marched to Cumberland Courthouse and there inspected and received by Baron Stuebe; That he continued to serve faithfully in the Army____? continental serving faithfully as a soldier on various skirmishes under the command of Baron Stuebe in the first regiment of Virginia Regulars in Continental Establishment commanded by Colonel Posey, Major Finley, Captain Shelton's Company. Always in service, was at the Siege of Yorktown where Lord Cornwall is surrendered after which he fell under the command of General Anthony Wayne and was marched south and was at the time of the Evacuation of Charleston before that city ____ and also at Savanah;
That he then continued in the service until discharged as appears from the certificate attached.

And he further Swears that he has always been a resident citizen of the United States, that he has lived the County of Haywood for Near nine years, that he has not for the purpose of bringing himself within of an act of Congress 18th of March 1818 and subsequent acts of Congress making provision for pension engaged in Land & Naval Service of the United States during the Revolution War conveyed away any of his property debts or claims either as land equity for the purpose of receiving any ____? thereby for the purpose of obtaining a pension from the United States that he is infirm having met with the misfortune to have his back and loin so that he cannot obtain a comfortable subsistence by his body labors that he has no other property of any kind or claim either Land or Equity by which he expects to gain any benefit except that contained in the following. to be all to wit.

Has Contracted for a the tract of 50 acres of land at $75.00 and paid only $9.75 and no money to pay balance and the State will not give him the land until paid for that he live on the State land with any title & have a wife 55 years old and infirm and is consumptive habit & three children with his, a son nearly of full age, a daughter about 12, and a little boy about 10 years of age and no way to support but his trade of a Farmer which he is not able to do much at.

While I was doing some work for another client last summer I found the enclosed Underwood papers. I don't know if they have anything to do with your group, but I seem to remember there being something about a Barrat (?) and a John in the file somewhere and so I had them copied. The papers from the Wilkes County Records at the NC State Archives, file #C.R.1O4.1O1.3, "Apprentice Bonds and Records, 1778-1908", folders "1800-1815" and "1816-1825" (I didn't read beyond the end of the 1825 folder, so there may be other Underwoods in the later papers; I did read the earlier folders). Because the first document is so hard to read, I'll do what I can to transcribe it here - and abstract the others so I'll know what I sent you because I'm not keeping copies in my Underwood file:

Folder "1800-1815": This Indenture made this 6th Day of December in A.D. 1805 Between Anna Underwood of the One Part & John Ruffin Johnson of the Other Part Both of the County of Wilkes And State of North Carolina And Such that the Said Anna Underwood doth hereby come Forward with her with her own free will & accord & doth Hereby Grant Unto John R. Johnson her Lawful Indenture and Willingly binds herself unto the Said Jn0 R. Johnson Twenty One Years from the Present date to Serve & Obey him the Said John R. Johnson As full & Ample A Manner As the Law Cont Direct Or Prescribe ******* to Serve **** the Said Jn0 R. Johnson & Not Desert from him no Absent herself Out of his Service During the whole Space of the Twenty one Years herein Mentioned - & Also At the Same time she the Said Anna Underwood doth Hereby of her Own free Will & Accord d th hereby Indenture & Bind unto the Said John R. Johnson her Own Daughter named Betsey Underwood and her Own Son Named Joel Underwood which Two Children She the Said Anna Underwood doth of her own Accord Bind & Indenture unto the Said Jn0 R. Johnson for the Term & space of Twenty One years which Two Children She the Said Anna Underwood doth Bind and Indenture to Serve and Obey him the Said Jn0 R. Johnson to Serve him faithfully until the Twenty One Years Expired & not to Depart from Said Johnsons Service Without Leave & Now I Anna Underwood for Myself and in behalf of My Own Children doth hereby Acknowledge Ourselves as legally Indentured and bound unto the said John R Johnson, in as full and Ample a Manner as the law or form Contd  Requires for Which service said Johnson Is to furnish them with them with warm clothes and Victuals At h** ~ & ***isson.
Given Under My hand and Seal the Date above Written. [Signed] Anna (X her mark) Underwood. [Witness - there are three witnesses but I can read the name of only one of them, Gregory (X his mark) Payn]

[This is an unusual indenture - most were for seven years, and those for children normally only lasted until they were 21, not for 21 years. See the others, below.]

Abstract of other Bonds:

13 July 1804: an orphan boy named Barot Underwood "6 years next 12 this [which probably means that part of the bond was filled out before the 13th and that Barot had his 6th birthday on 12 July]" was bound to Charles (signed with a mark) to learn the occupation of farmer.

7 May 1823: an orphan boy named John Underwood aged nine years bound to
William P. Waugh as apprentice and servant until John arrives at age of 21;
William to teach John the art and mystery of a farmer and given him when free a suit of Clothes and a Horse Breidle and Saddle worth seventy dollars.

Same day: an orphan girl named Jane Underwood aged about 13 bound to William Waugh to learn art and mystery of a Spinster and to receive when free a pair of cards [used for spinning]

1st Monday of Aug, 1825 William Waugh summoned to the court to make known why an orphan girl named Susannah Underwood, bound to him, shouldn't be bound to some other person.
