Daniel ROBINETT

Historical Notes:

    According to "Annals of Southwestern Virginia" by L. P. Summers, a claim
was allowed Daniel Robinett on November 22nd, 1785 in Montgomery County
Virginia, (p. 806).  On September 26th, 1786 he was appointed Lieutenant in
Captain William Davies Company of the Montgomery Militia, (p-815); and in the
organization of Wythe County 25th Day of May 1790, Daniel Robinett was made a
Lieutenant of that County's militia.  He is listed in the 1790 Montgomery
County Tax List "B", along with his brothers, James and Michael.

    Montgomery Survey Book "D", lists Daniel Robinett, 45 acres on north side
of former survey, 25 january 1790.

    Robert Adams, David Fannin, John Breckinridge and George Owry acted as
witnesses for Daniel Robinett in 1790 at Wythe County when Daniel purchasd 150
acres of land from Robert Steel for ten pounds current money of Virginia, land
lying on Walker's Creek where the said Daniel Robinett lives with Henderson
Creek crossing the land at one end and Broydes Branch crossing near the other
end.  Acknowledged at Court held for Wythe County the 12th day of June 1792,
and ordered recorded.

    According to Daniel Robinett's survey, dated March 9th, 1797, Survey Book
I, page 408, at Wythe County, Virginia.  "He was given 80 acres of land by
virtue of part of ancestry of 92,000 acres of land, is made in the name of
Gordon Cloyd and Alexander Smythe the 15th day of July 1795 on a certificate of
a Treasury Land Warrant No. 1312, from the principal surveyor of Montgomery
County issued the 22nd day of April 1795.  Said 80 acres of land was approved
by said Gordon Gloyd and said Smythe to said Robinett the 22nd day of April
1797, lying in Wythe County on Walker's Big Creek beginning at a corner to the
land of Thomas Dunn, deceased and ends up below a large spring on a line of the
land of Thomas Dunn, deceased."

    In 1834 at Wythe County, Virginia, Daniel Robinett Sr, and his wife Nannah
(Deed was signed as Ann Robinett) James Robinett and his wife Jerusha sold land
adjoining Samuel Robinett's land and Michael Robinett's land.

    Daniel Robinett's Will was dated 21 June 1838 and proved in court on 10
January 1842 and 10 December 1851.  Witnesses: Dunn Bogle and Cyrus Adams.  He
died sometime after the 1840 Census and before the signing of the deed from
Mary Dunn to Henry Grayson where the living heirs of Samuel Robinett, (# 1351
Robinett Family Records), signed, including the children of Daniel, but not
Daniel.

    The Will of Daniel Robinett reads as follows:

    "I Daniel Robinett of the County of Wythe and State of Virginia do make
this my last Will and Testament, after my death I wish my funeral expenses to
be paid, I owe no debts to any person, I wish my property, both real and
personal to be divided in the following manner, that is to say:

    (1) In the first place I give and bequeath to my wife Anna my dwelling
house and one third of my farm, including cleared land enough to support her,
and timbered land for fire wood and nails.  I also give her one feather bed,
and bedstead with all necessary covering, also one cow, I wish her the have
choice of all my stock, also one bay mare, four years old this spring, all of
which she is to have during her natural life and on the event of her death, the
personal property she may have is to be divided among those of my children that
is single at the date of this Will.

    (2) I give and bequeath to my daughter Elizabeth the following property,
one spotted mare, her spring colt, and two spotted filleys, colts of the old
mare. I give to her nine head of cattle, I give to her ten head of sheep, I
give to her two beds and furniture.

    (3) I give to my daughter Sophrona one brown filly, three years old, nine
head of cattle, ten sheep, I give her two beds and furniture.  I give to my
daughter Leonary one brown mare and a brown horse five years old, nine head of
cattle, ten head of sheep, two beds and furniture.

    (4) I give to my daughter Margaret one black horse and one yearling colt
of the sorrel mare, nine head of cattle and ten head of sheep two beds and
furniture.

    (5) I give to my son George one dark bay filly, nine head of cattle, ten
head of sheep one bed and furniture.  I give and bequeath to my son George
Robinett one hundred acres of land embracing the dwelling house, it is my wish
and will for his shear to be laid off at the upper end and to begin at the
north east end of the little fields which lower field on Breads Branch and run
so as to take in the orchards, and out to the ridge, thence a west direction to
a straignt line will run between him and Isaac Reprass, thence and easterly
direction to the beginning.  All the balance of my land I wish to be divided
between my four daughters that is now at home with me and single.  I wish it to
be divided to the best advantage for them so as to give each water and wood.
It is my Will Elizabeth's lot is to be laid off adjoining George below, the
other three are to have theirs according to their age, the oldest Saphrona to
have the next choice, and so on; I do constitute and appoint myh son James
Robinett my Executor, and it is my wish that he is not to give security for
executorship.  Signed with my hand and sealed with my seal this twenty first
day of June in the year of our Lord, one thousand eight hundred and thirty
eight.

Historical Notes:

    On April 22nd, 1855, Walker's Creek, death was recorded in the name of
Mary Ann Robinett, widow of Daniel Robinett, age 80 years, 6 months, born in
North Carolina, daughter of Daniel and Elizabeth Justice.  Entered by Elizabeth
Robinett, daughter.
