Carpenter and farmer in the Kearney Nebraska area. Died of a Heart attack at
his son's (Walt May) home.
Death caused by an illegal abortion. Pregnancy caused by City Attorney Joseph C
Saylor. The abortion was performed Eva Corbin at the Corbin
Sanitarium on October 30th 1917.Dr. Kirby, Joseph Saylor and Eva Corbin were charged with the crime
of aiding and procuring the abortion which was performed by Eva Corbin. The jury found the defendants not guilty because the testimony taken at the
Coroner's inquest was ruled out. Dr Kirby's name does not appear in the court
proceedings in May of 1918, only charges against Eva Corbin and Joseph C Saylor
appear in the court records. Why the corner's inquest indicates guilt of Dr
Kirby but the district court records show no charges I do not know.
