Benjamin Tipton's will from We Tiptons and our Kin Sevier Co., Tenn
Will Bk. No 1.
pp. 92-93

      I Benjamin Tipton, do make and publish this my last Will and Testament hereby Revoking and making void all other wills by me at any time made;
      First: I direct that my funeral expenses and all my debts be paid as soon after my death as possible, out of money that I may die possessed of or first may come into hands of my Executor.
      Secondly: I give and bequeath to Calaway Cagle, and Jane Cagle, one tract of land lying and being in the County of Sevier and State of Tennessee, and in the district No. 10 containing by estimation fifty acres, known as the Cagle Tract, and also that the said Callaway and Jane Cagle have one bed, Bedstead and furniture each;
      Thirdly: I give and bequeath to my two sons Benjamin F. Tipton and Marion Tipton and my two daughters, Tennessee McPherson and Rebecca Boling one tract of land containing one hundred acres more or less, it being the tract on which I now live, and also I give to said sons and my two daughters above named, My Mountain Land, supposed to be seven hundred acres more or less,-
      Fourthly: I direct that my personal property, that I may die possessed of be sold and the money equally divided between my above named heirs, Benjamin F. Tipton, Marion Tipton, Tennessee McPherson, Rebecca Boling, Calaway Cagle and Jane Cagle.
      Filthily: If my wife Polly Tipton, should survive me, then she is to have the fifty acre tract during her lifetime, and also the household and kitchen furniture, during her lifetime.
      Lastly: I appoint Cromwell Delozier, my Executor, to execute this my last Will and Testament-Signed Sealed & and & in our presence this 6th day of September, 1865.

Who are Callaway and Jane Cagle? Could they be Benjamin's grandchildren?
Does Jacob belong here? Could he have moved his family elsewhere? Would that account for him not being in the will? Or did he die before Benjamin?

Recently, I came across a Jane Tipton age 24 living with Pleasant Carver in the 1880 census for Sevier Co., TN. Jane was mentioned as his niece. Also living with him was Calaway Tipton. He was born in June. No relationship was listed between Pleasant and Calaway. More research led me to find Jane Tipton age 14 living with Pleasant Carver in the 1870 census. Is there a connection here? Could the Jane and Callaway Cagle be the same Jane and Calaway Tipton? What is the connection to Benjamin?

Military service: Bet. September 23 - December 31, 1813, Private

Nancy BROOKS

It would seem that if Benjamin and Nancy were married about 1812 and Jacob does belong here, there must have been several other children born between 1813 and 1822 when the next child was born. The other children must have died. More research is needed to prove this line.
